Terms and Conditions:
1. The Promoter of the programme is Curramore Pty Ltd, trading as Tackleworld Hervey Bay ABN 27 010 973 761. 59 Torquay Road Pialba QLD 4655.
2. The name of the programme is “Tackleworld Hervey Bay Loyalty Rewards”
3. In these terms and conditions: “Loyalty Rewards Card” means a membership card issued pursuant to this programme. “Member” means an individual who is an Australian resident, and whose application to take part in the programme is accepted. “Membership” means membership in this programme. “Programme” means the Tackleworld Hervey Bay Loyalty Rewards Programme operated pursuant to these terms and conditions.
4. By using a Loyalty Rewards card, each member or applicant accepts and agrees to be bound by these terms and conditions, including any variations made from time to time, to the terms and conditions.
5. Membership in the programme is open to Australian residents only and is subject to acceptance of an application. Membership will only be established on receipt and acceptance of an application for membership by Tackleworld Hervey Bay and Tackleworld Hervey Bay reserves the right to refuse any application in their absolute discretion.
6. Each card issued will remain the property of Tackleworld Hervey Bay and must be returned to Tackleworld Hervey Bay on demand. Any lost card may at the sole discretion of Tackleworld Hervey Bay be replaced. The member must notify Tackleworld Hervey Bay immediately if a card is stolen or lost. Tackleworld Hervey Bay will not be liable for any delay in replacing a card.
7. The member is responsible for the safe keeping of their card and Tackleworld Hervey Bay will not be liable for any unauthorised use of a card. The member will be responsible to advise Tackleworld Hervey Bay if they discover any unauthorised activity.
8. The members card can only be used by the member and is not transferable. A members card can only be used on presentation and must be accompanied with suitable personal identification as determined by Tackleworld Hervey Bay.
9. The member hereby irrevocably holds harmless, Tackleworld Hervey Bay, its related entities, employees, directors, suppliers, and agencies from all claims, suits, demands, actions, and proceedings which the member has or may have in the future, and shall indemnify and release Tackleworld Hervey Bay, its related entities, employees, directors, suppliers and agencies from all claims for damages or otherwise in the terms and conditions of and arising out of this programme.
10. Tackleworld Hervey Bay will not be liable for any delays, disruptions, omissions or errors in the operation of the programme, including technical or mechanical malfunctions and will not be liable for any loss caused by any such delays, disruptions, omissions or errors.
11. The member acknowledges and agrees that all decisions pertaining to this programme rest solely with Tackleworld Hervey Bay.
12. Tackleworld Hervey Bay in its sole discretion can at all times change, amend or vary these terms and conditions, change, amend, vary, withdraw or cancel any promotional offer to members, exclude a member from or cancel a membership, in the programme without prior notice to the member.
13. Tackleworld Hervey Bay gives no warranty as to the continued availability of the programme and may in its absolute discretion, at any time cancel the programme in whole or part, without prior notice.
14. To the extent permitted by law, Tackleworld Hervey Bay, its related entities, employees, directors, suppliers and agencies is not liable for any loss or damage suffered by members resulting from any such withdrawal, cancellation, variation or change as set out in clauses 12 and 13 arising from the programme.
15. Privacy: Tackleworld Hervey Bay and/or its agents on its behalf, collects the members personal information in order to operate the programme. If the required information is not provided the member may not participate in the programme. By making an application, unless otherwise advised the member consents and authorises Tackleworld Hervey Bay and/or its agents to use this information for the purpose of conducting the programme. In addition, this personal information and any other information that is obtained via the programme may be used by Tackleworld Hervey Bay for future promotional, marketing and research purposes in any form of media, including without limitation to communications made via electronic messages. (as described in the spam act 2003).
16. Governing Law: The terms and conditions and membership in the programme are governed by and will be construed in accordance with the laws of the State of Queensland. Any action or legal process with respect to any matter in connection with these terms and conditions must be instituted and carried on in the appropriate court or tribunal of Queensland.
17. Nothing in these terms and conditions affects any rights a member may have and which by law may not be excluded under any statute including the trade practices act (1974).
